I am beyond disheartened at the ruling coming out of the Supreme Court of the United Stated (SCOTUS) this morning. What a blow to all workers who are being harmed by unfair employment practices. As Justice Ginsburg said so succinctly in her dissent: "...the Court’s decision is egregiously wrong..."
RBG and the rest of us call on Congress to fix this, now. "Congressional correction of the Court’s elevation of the FAA over workers’ rights to act in concert is urgently
in order." It is time to get serious and ask Congress to pass the Arbitration Fairness Act (H.R.1374, S.537).
Arbitration in consumer and employment cases is not justice. The FAA was passed to give equal footing to two or more sophisticated companies who wanted to avoid litigation and get a ruling without a jury.
Arbitrators are paid by the company, in lieu of a judge or jury, and those individuals are incentivised to rule in favor of the company so that they can get hired again. It quashes individual freedom, gives even more power to companies, and takes the voice from the individual.
